Legislative Council Electronic Petition
The Petition of certain citizens of the State of Victoria draws to the attention of the Legislative Council that the Transport Accident Act 1986 does not provide adequate cover for international residents. Due to the coronavirus restrictions, parents of an international resident could not travel to Victoria after their son was killed while driving without any fault on a Victorian road. The Transport Accident Commission would have otherwise covered the expense of approximately $5400. These parents are seeking to perform a final ritual of sending their son’s ashes to sea but do not have enough funds for this final send‐off. This gap in the Transport Accident Act 1986 needs to be updated so that the law can accommodate these types of scenarios with international residents, specifically recognising aged parents as a category of financial dependents. The petitioners therefore request that the Legislative Council pass a Bill to amend the Transport Accident Act 1986 to address the gap of funding for the road deaths and accidents of international residents and to recognise aged parents as a category of financial dependents.
